SIGN VARIANCE COMMITTEE
MINUTES FOR THE
JULY 5, 2007 MEETING

        The Sign Variance Committee met on Thursday, July 5, 2007 at 5:30 P.M., in the Council Chambers of the Village of Evendale Municipal Building.  Chairman Ted Mueller, Council Representative Stiney Vonderhaar, Fred Caston, Bob Luther, and Wayne Mosley were present.  Also present was Anne McBride, from McBride, Dale, Clarion, Jack Cameron, Assistant to the Mayor, and Pam Morin, Building Department.

        Mr. Vonderhaar opened the meeting at 5:35 P.M.; Ted Mueller arrived at 5:50pm.   Mr. Vonderhaar made a motion that a proclamation or letter be presented to retired member Pat Finan for his many years of service on the Sign Variance Committee.  Fred Caston seconded that motion and the motion passed with the vote of 4 – 0, Ted Mueller was absent for this vote.

        A second motion was made by Mr. Vonderhaar nominating Ted Mueller as Chairman of the Sign Variance Committee.  The motion was seconded by Wayne Mosley.  It passed with the vote of 4 – 0, Ted Mueller was absent for this vote.

The committee heard the following request:

        Starbucks, 2520 Cunningham Drive

        Anne McBride presented for Starbucks.  Mrs. McBride gave a brief explanation of the request and described the hardship related to the site topography and the current sign’s line of sight being blocked by several utility poles from the east and the landscaping wall and planter from the west for the current sign location.  These conditions make the sign nearly impossible to see from both directions on Glendale-Milford Road.   Duke Energy had been approached previously by the developer about moving the utility poles, but they are unwilling to do so.  

The existing sign is 20 feet from the right-of-way and 45 feet from the edge of road.  Starbucks would keep the size and height of the new sign identical to the existing sign and has requested a 9 foot variance in the required setback.  This would place the new sign 26 feet from the edge of the road.

        Ms. McBride explained that following chart:

        Jack Cameron explained that Starbuck appeared before Planning Commission twice, June and May meetings.  At the first meeting, they requested that the height of the sign be raised to 14 feet from the current 7 feet.   Planning Commission passed a motion to table the request until the next meeting in order to allow Starbucks to explore other options, such as relocating the sign as close as possible to the right-of-way line.  Starbucks new proposal kept the identical sign but moved it one foot from the right-of-way.  This would allow the new sign to keep within the PBD height and size requirements and not creating a precedent for other tenant requests.  Section 1262.009(d) of the Village of Evendale Zoning Code, allows Planning Commission to approved signs to within 10 feet of the right-of-way.  Planning Commission made a motion to approve the 10 foot setback and recommended that Sign Variance grant the 1 foot setback.
        
After a brief discussion, a motion to recommend to Council to allow the 9 foot variance was made by Mr. Vonderhaar and seconded by Mr. Mosley.  This motion passed with the vote of 5 – 0.

        Mr. Mosley made a motion to accept the minutes of the October 10, 2006 meeting as read and seconded by Mr. Vonderhaar.   The motion was passed with the vote of 4 – 0, with Mr. Luther abstaining.

        Mr. Luther made a motion to adjourn the meeting and seconded by Mr. Mosley.  The motion was passed with a vote of 5-0.  Meeting was adjourned at 6:10pm.
